This meeting will be held virtually and in-person at the Council Chambers located on 2415 University Ave, First Floor East Palo Alto, CA 94303. The virtual portion of this City Council meeting will be conducted in accordance with City of East Palo Alto Resolution adopted pursuant to Assembly Bill 361.

The public may participate in the City Council Meeting via Zoom Meeting or by attending in-person in the Council Chambers at 2415 University Ave, First Floor East Palo Alto, CA 94303. Community members may provide comments by emailing cityclerk@cityofepa.org, submitting a speaker card at the meeting, or using the RAISE HAND feature when the Mayor or City Clerk call for public comment. Emailed comments should include the specific agenda item on which you are commenting.

3.1

The terms of the tentative agreement reached between the City of East Palo Alto and the East Palo Alto Police Officers’ Association (POA) and the revised and Memoranda of Understanding (MOU) that reflects those agreements for Fiscal Year (FY) 2024-27

 

Recommendation:

Adopt a resolution approving: 

  1.  The terms of the tentative agreement reached between the City of East Palo Alto and the East Palo Alto Police Officers’ Association (POA) and the revised and Memoranda of Understanding (MOU) that reflects those agreements for Fiscal Years 2024-25 through 2026-27. 

3.2

Interagency Agreement with West Bay Sanitary District

 

Recommendation:

Adopt a resolution authorizing the City Manager to award to, negotiate, and execute an interagency agreement with West Bay Sanitary District, in a form approved by the City Attorney.

3.3

Plan to Establish an Advisory Committee to the Governing Body of the EPASD Subsidiary District.

 

Recommendation:

Authorize the City Manager to submit to LAFCo the proposed plan to establish an advisory committee to the governing body of the EPASD subsidiary district. 

3.4

Amendment of Code of Ethics and Conduct for Elected and Appointed Officials

 

Recommendation:

Adopt a resolution amending the City of East Palo Alto “Code of Ethics and Conduct for Elected and Appointed Officials” to establish a Council protocol for agenda setting.

3.5

Trash Capture Devices Installation Project (Capitol Improvement Project SD-08)

 

Recommendation:

Adopt a resolution authorizing the City Manager to award to, negotiate and execute a construction contract, in a form approved by the City Attorney, with United Storm Water, Inc., in the amount of $118,908.30, establish as 10% construction contingency in the amount of $11,890.83, for a total not-to-exceed amount of $130,799.13, and authority to execute future change orders in an amount not-to-exceed the appropriated construction contingency to provide construction services for the Trash Capture Device Project (“Project”).

3.6

Calling the November 5, 2024, General Municipal Election

 

Recommendation:

Adopt a Resolution:

  1. Calling and ordering a Tuesday, November 5, 2024, General Municipal Election for the City of East Palo Alto, for the purpose of electing three members to the City Council; and
  1. Authorizing the City Manager to enter into a service agreement with San Mateo County’s Chief Election Officer to conduct the election.

3.7

Approval of Contract for Measure HH Pilot Workforce Development Program Final Evaluation

 

Recommendation:

Adopt a resolution:

  1. Authorizing the City Manager to award to, negotiate and execute a one-year contract with Informing Change, in a form approved by the City Attorney, in an amount not to exceed $120,000 to conduct a final evaluation of the Measure HH Pilot Workforce Development Program;
  2. Finding the proposed action does not constitute a “project” with the meaning of the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines sections 15378(b)(4) and (5) in that it is a governmental fiscal, organizational or administrative activity that will not result in direct or indirect changes in the environment; and
  3. Appropriating additional funds in the amount of $45,000 from Measure HH Fund in the Fiscal Year 2024-25 Budget.

Adopt Annual Compensation Schedule for FY 2024-25

 

Recommendation:

Adopt the Fiscal Year (FY) 2024-25 Compensation Schedule.

8.1

Woodland Park Euclid Improvements Design Review Permit Amendment

 

Recommendation:

1. Approve the proposed design review permit amendment (DR24-001) and tree removal permit (TRP24-008) based on the findings, requirements and conditions of approval attached thereto and incorporated by reference; and
2. Finding that no subsequent or supplemental Environmental Impact Report is required pursuant to Section 15162 of the California Environmental Quality Act Guidelines.

FY 24-25 Inclusionary In-Lieu Fee Update

 

Recommendation:

Adopt a resolution updating the Inclusionary Housing In-Lieu Fees for Fiscal Year 2024-25, to amounts of $273,400 for Ownership/For-Sale and $299,200 for Rental, or some other alternative approved by City Council. 

8.3

Introduction of an Ordinance Amending the Salary for Members of the East Palo Alto City Council.

 

Recommendation:

By motion, waive the first reading and introduce an ordinance amending Section 2.08.150 of the East Palo Alto Municipal Code increasing the salary for members of the East Palo Alto City Council.

POLICY AND ACTION

 

9.1

Pre-Application for a: 1) Conforming rezoning (Zoning Map Amendment) of a 2.11-acre portion of an existing 2.536-acre parcel at 1933 Pulgas Avenue from R-MD-1 Multiple-Family Medium Density Residential Subzone 1 to R-MD-2 Multiple-Family Medium Density Residential Subzone 2; 2) Tentative Tract Map to subdivide the 2.536-acre parcel into two 2.11-acre and 0.426-acre lots and further subdivide the former into 62 airspace condominium units and common areas for parking, open space and other shared amenities; and 3) Design Review permit to develop a 62 unit single-family attached (rowhouse) project in East Palo Alto, CA 94303. APN 063-492-280

 

Recommendation:

Review the Pre-Application (PRE24-001) for 1933 Pulgas Avenue and provide the following feedback to the applicant and City staff prior to formal application:

 

  1. Zoning Map Amendment to rezone a 2.11-acre portion of an existing 2.536-acre parcel from R-MD Subzone 1 to R-MD Subzone 2.

 

  1. Subdivision of the original 2.536-acre parcel into two lots followed by a condominium map for 62 rowhouses on the rezoned portion of the site.

 

  1. Site Design and Architecture approval of the proposed rowhouse development

9.2

City Banner Program and Policy

 

Recommendation:

Adopt a resolution approving establishment of a Banner Program and Policy as outlined in this report. 

9.3

Approval of Ballot Argument Language for the Citizen Initiative

 

Recommendation:

By motion, approve the ballot argument language as drafted by the ad hoc committee (Councilmembers Ruben Abrica and Carlos Romero), make any amendments thereto, and authorize staff or the ad hoc committee members to take all necessary steps to file the ballot argument with the County Elections Office.
